PRODUCTS
The images of the Products in the eShop are provided for illustrative purposes only. Although Seller makes every effort to display the colours of the Products as accurately as possible, Seller cannot guarantee that Buyer's device screen will accurately display the colours of the Products. Buyer understands that the Products may differ substantially from their images.
The packaging of the Products may differ from that shown in the images provided in the online shop and some Products are sold without packaging which is not provided by the manufacturer.
Unless otherwise specified, all the Products offered in the online shop are available in stock or from the supplier. In the event that the Products ordered cannot be sold due to any circumstances, the Buyer shall be informed by e-mail or other means of communication (telephone or SMS) and the order for such Products shall be cancelled.
The Seller reserves the right to set a minimum and/or maximum order quantity for a particular Product in a single order.
PRICES AND PAYMENT FOR PRODUCTS
The prices of the Products will be as quoted in the online shop. The Seller shall use all reasonable endeavours to ensure that the prices of the Products are correct at the time the Buyer places the order. Seller reserves the right to change the prices and discounts of the Products and the delivery costs of the Products at any time without notice, but such changes will have no effect on any contract already entered into.
When ordering the Products, the Buyer may pay for the Products by one of the following payment methods:
- using the Paysera payment system
- by cash when receiving the products at our shop at Raiņa iela 28, Daugavpils, Latvia, on workdays from 09:00 till 18:00, on Saturdays from 09:00 till 15:00.
- by payment card upon receipt of the products in our shop at Raiņa iela 28, Daugavpils, Latvia, on workdays from 09:00 till 18:00, on Saturdays from 09:00 till 15:00.
The moment of receipt of payment is considered to be the moment when the particular payment has reached the current account of SIA "AutoEŽ".
All prices are quoted in euros (EUR) and include applicable statutory taxes. In the event of a change in the VAT rate between the order date and the delivery date, the price may change to reflect the change in the VAT rate, unless the Products have been paid in full by the Buyer before the VAT rate change takes effect. The prices quoted do not include delivery costs, which depend on the place of delivery. The current prices for delivery can be found in the section entitled 'Delivery and delivery costs'.
DELIVERY AND DELIVERY COSTS
The Buyer undertakes to indicate the exact place of delivery of the Products when choosing the delivery service offered at the time of ordering. The exact delivery price depends on the weight and price of the Products ordered. Oversized, non-standard size Products such as chairs, fishing tents, etc. of this or similar types as well as Products which cannot be packed in a pacomat shall be delivered by DPD or Omniva courier only. Unloading and loading services shall be paid for by the Buyer.
You can receive your products as follows:
- Omniva or DPD pickup - order processing and dispatch within 24 hours of receipt of payment. Delivery time is one to three working days.

A DPD or Omniva courier will deliver your order to the address you specify, contacting you in advance and agreeing the delivery time.
- in our shop Shark, Raiņa iela 28, Daugavpils, Latvia - after the payment has been transferred to our bank account, you can pick up the goods at our shop. If you decide to collect the product in our shop, you can also pay in cash or by credit card.

The Buyer shall inspect the packaging, quantity, quality, range, accessories and assembly of the Products within 14 days of delivery. If the Buyer fails to fulfil this obligation within the specified period and does not lodge a complaint with the Seller, the packaging of the Products shall be deemed to be in proper condition and the quantity, quality, range, accessories and assembly comply with the contract.
RETURNS AND RIGHTS OF WITHDRAWAL
Pursuant to Cabinet Decision No. 255 of 20 May 2014 "Regulations on distance contracts", the purchaser has the right to withdraw from this contract within 14 (fourteen) calendar days without giving a reason and return the goods purchased in the www.shark-daugavpils.lv online shop to the retailer without undue delay and in any case no later than 14 days from the date on which the purchaser or a third party other than the carrier indicated by the purchaser has taken possession of the product.
The exercise of the right of withdrawal expires 14 days after the date on which the buyer, or a third party other than the carrier nominated by him, has taken possession of the products.
In order to exercise the right to withdraw from the contract, the buyer must inform us, SIA "AutoEŽ", Raiņa iela 28, Daugavpils, LV-5401, +371 23991599, e-mail address: info.sharkdaugavpils@inbox.lv about the decision to withdraw from the contract.
The costs of returning the product shall be paid by the buyer.
Money for returned products will be refunded within 10 working days.
Please note that S IA AutoEŽ does not accept returns of products sent by pickup as it is not possible to fix the visual damage of the product and the contents of the parcel in the presence of both parties at the time of receipt.
By sending the product by courier, the customer agrees that SIA AutoEŽ unilaterally determines the visual and technical condition of the product and its contents at the time of receipt. Further claims by the customer that he/she does not consider that it corresponds to what was sent will be considered unfounded, therefore we recommend handing over the goods in person to Raiņa iela 28, Daugavpils.
- The purchaser shall only be liable for a reduction in the value of the product if the products have been used for purposes other than ascertaining the nature, characteristics and functioning of the product.
- During the period of exercise of the right of withdrawal, the purchaser has the right to use the product to the extent necessary to verify its nature, properties and characteristics (to the same extent as would be possible before purchasing the product in a normal shop).
- When exercising the right of withdrawal, the purchaser is responsible for any use of the product beyond that which is intended to test the nature, properties and characteristics of the product.
- The purchaser shall be liable for any use of the products during the exercise of the right of withdrawal which is incompatible with the principle of good faith, and for any reduction in the value, quality and safety of the products.
- The buyer is responsible for maintaining the quality and safety of the product during the period of exercising the right of withdrawal.
- www.shark-daugavpils.lv reserves the right to refuse the right of withdrawal or to charge a compensation fee if the product has been used and/or damaged, if it is not in its original packaging or if its packaging is substantially damaged.
THE CONSUMER CANNOT EXERCISE THE RIGHT OF WITHDRAWAL:
In the cases stipulated in paragraph 22 of Cabinet of Ministers Decision No. 255 of 20 May 2014 "Regulation on distance contracts", including if
- the price of the commodity is subject to fluctuations in the financial market that are beyond the seller's control and that may occur during the period of the right of withdrawal;
- the product is made according to the consumer's instructions or is clearly personalised;
- products that are perishable or have an expiry date;
- the purchaser has opened the audio or video recording or the packaging of the computer software;
- the purchaser has opened the packaging of an item that cannot be returned for hygiene reasons;
- the products have been irreversibly intermingled with other products because of their characteristics after delivery
The Buyer shall notify the Seller of termination of the Contract in one of the following ways:
- by completing the withdrawal form in the 'Application Forms' section of the online shop
- by submitting a clear application (petition) stating their decision to withdraw from the Contract and complying with the provisions of the RTS and the Cabinet of Ministers Regulations.
QUALITY AND GUARANTEE
The products offered for sale on www.shark-daugavpils.lv are covered by the manufacturer's guarantee, which is provided in accordance with the legislation of the Republic of Latvia, provided that the products are used in accordance with the instructions for use and for the purposes intended by the manufacturer.
The products sold by the Seller to the Buyer are subject to all the guarantee terms and warranty periods prescribed by the manufacturers of those products, as defined in the technical documentation of the specific products, if any. The warranty period commences on the date of sale of the relevant products to the Buyer.
During the guarantee period, if repairs are necessary, the Buyer shall return the product to the Seller in the place indicated by the Seller, by courier, by post or in person. The goods must be returned to the address of the Seller and the return may be reported by e-mail: info.sharkdaugavpils@inbox.lv with the following information in the subject line: product defect, signs of damage, in addition to proof of purchase - receipt and completed guarantee claim form.
When submitting a complaint, the Buyer shall specify one of the ways in which the Buyer wishes the complaint to be resolved:
- by remedying defects in the Products - defects - by the Seller without charge within a reasonable time, if the defects can be remedied in accordance with the terms of the garantee;
- reduce the purchase price accordingly, taking into account depreciation of the Products or the benefit received by the Buyer from the use of the Products and agreed between the Seller and the Buyer;
- replace the Products free of charge within a reasonable period with similar Products of the same quality, unless the defects are minor/insignificant or are the fault of the Buyer;
- cancel the Contract and refund to the Buyer the amount paid for the Products, unless the non-conformity of the Products is minor and would not affect the Buyer's ability to use the Products. A non-conformity with the Product is considered minor if it does not significantly impair the performance or usability of the essential functions of the Product and can be remedied without a visually detectable change in the appearance of the Product.
The Guarantee covers only the defective part and does not cover service work related to its replacement, transport costs, etc. If the product cannot be repaired and has to be replaced, the Buyer must return it to the Seller in its original packaging and original equipment, unless this is not required by the manufacturer's guarantee conditions of the respective product. If it is established during the guarantee examination that the product sent abroad for guarantee repair complies with the manufacturer's specifications, standards and technical conditions stated in the technical documentation for the product and is fully operational, or if the product has been damaged (as a result of unauthorised repair/installation, unauthorised change of assembly, etc.).
The guarantee is only valid for products purchased at www.shark-daugavpils.lv.
The costs of normal maintenance, preventive maintenance or replacement of non-defective parts shall be borne by the purchaser.
The guarantee does not apply to the transport of the product to a workshop and delivery after repair. Guarantee repairs are only carried out at the appropriate service centres.
The guarantee is voided:
- If the defect is caused by improper use, alteration, modification, poor maintenance, insufficient care or negligent maintenance.
- If the damage is caused by failure to comply with the instructions in the user manual.
- If the product has been repaired by yourself or any service other than a certified repair centre.
- If the goods have been used commercially;
- If the purchaser is unable to provide proof of purchase in the form of a receipt and a properly completed guarantee card;
- The Guarantee does not cover normal wear and tear, scratches and mechanical defects that do not affect the full functionality of the product.
- All provisions and reservations not covered by these Conditions of Guarantee shall be governed by the Conditions of Sale.
